Terms and Conditions for Myspacebnb

Welcome to Myspacebnb, a peer-to-peer platform for booking bed-and-breakfast ("BnB") or storage spaces ("Storage"); by using our website, you agree to these Terms and Conditions.

Key Policies

We charge no commissions and users get paid exactly what they earn. Listing properties or booking a property means users agree to have no insurance on the listing and property and they are solely responsible for the wellbeing of themselves or their property and they agree to ensure they deny access or service to any guest who exhibits any reasonable suspicious behavior.

1. Definitions

Guest: A user booking a BnB or Storage space via the Platform.
Host: A user listing a BnB or Storage space on the Platform.
Listing: A BnB or Storage space offered by a Host.
Booking: A confirmed reservation of a Listing by a Guest.
Service Fees: Fees charged by Myspacebnb for Platform use.
Content: Text, images, or materials posted on the Platform.

2. Eligibility

Users must be 18 or older and legally able to enter contracts. You must provide accurate registration information and secure your account. Myspacebnb may suspend or terminate accounts for violating these Terms or laws.

3. Platform Usage

Guests: Search Listings by check-in/check-out dates, location, and space type (BnB or Storage) using the Platform’s search tools. Bookings payment and Host confirmation .

Hosts: List BnB or Storage spaces, setting prices, availability, and rules. Listings must be accurate, safe, and legal.

Bookings: Confirmed upon Host acceptance and payment. Both parties must honor Booking terms, including space type and dates.

4. Payments

Processing: Guests pay Listing fees, and taxes at booking via Myspacebnb’s payment system.

Host Payouts: Hosts receive funds post-check-in, per Myspacebnb’s payout schedule.

Fees Taxes apply to Guests.

6. User Obligations

Guests:

Follow Host rules and local laws.
Use BnB for lodging, Storage for permitted items only.
Report issues to Host and Myspacebnb promptly.

Hosts:

Ensure Listings are accurate, safe, and legally compliant.
Respond to Guest inquiries and Booking requests quickly.

Prohibited:

False Listings or account information.
Illegal activities, discrimination, or harassment.
Bypassing Myspacebnb’s payment system.

7. Content

User Content: You own your Content (e.g., Listing photos) but grant Myspacebnb a global, royalty-free license to use it for Platform purposes.

Platform Content: Myspacebnb’s logos, designs, and text are protected by copyright. Unauthorized use is prohibited.

Standards: Content must be lawful and non-infringing. Myspacebnb may remove violating Content.

8. Liability

Guest Responsibility: Guests are liable for damages caused during their Booking.

Host Responsibility: Hosts ensure Listing safety and accuracy. Myspacebnb is not liable for damages or injuries.

Platform Limitation: Myspacebnb is not responsible for user disputes, damages, or losses, except as required by law.

9. Disputes

Between Users: Guests and Hosts should resolve issues directly. Myspacebnb may mediate but isn’t obligated.

With Myspacebnb: Disputes must be reported within 30 days. Resolved via negotiation or arbitration in New York, NY, under the laws of the State of New York, USA.

No Class Actions: You waive class-action lawsuits against Myspacebnb.

10. Account Termination

Myspacebnb may suspend or terminate accounts for:

Breaching these Terms or laws.
Fraud or harmful conduct.
Repeated cancellations or poor performance.

Terminated users must stop using the Platform; pending Bookings may be canceled.

11. Privacy

Your data is handled per our Privacy Policy, detailing collection, use, and protection.

12. Changes to Terms

Myspacebnb may revise these Terms, effective upon posting. Continued use constitutes acceptance.

13. General

Law: Governed by the laws of the State of New York, USA, excluding conflict-of-law rules.

Force Majeure: Myspacebnb isn’t liable for delays due to uncontrollable events.

Severability: Invalid provisions don’t affect remaining Terms.
